Terms of Service
These terms govern access to Waffl properties and explain how public terms relate to a subscription checkout, order, proposal, or separate service agreement.

1. Acceptance and scope
These Terms of Service form an agreement between you and Waffl Inc. when you access gowaffl.com, use app.gowaffl.com, purchase an offer, or accept an order, proposal, or service agreement that refers to them.
A checkout, order, proposal, statement of work, or signed agreement may contain additional terms. The more specific accepted document controls for its subject if it conflicts with these public terms.
2. Eligibility, accounts, and security
You must be able to enter a binding agreement and must use Waffl for lawful business purposes. You are responsible for accurate account information, authorized users, credentials, and activity performed through your account.
Notify Waffl promptly if you believe an account or connected system has been accessed without authorization. Do not share credentials through a Discovery Call booking note or ordinary project message.
3. Offers, prices, and separate scopes
The current public offers list WafflOS at $175 per month, Launchpad at $1,000 one time plus an active WafflOS subscription, and Fractional COO engagements at $3,200 per month for Advise, $4,200 per month for Operate, and $6,000 per month for Embed. Fractional COO engagements have a one-quarter minimum and require active WafflOS.
Displayed prices are starting or standard prices, not a promise that every requested scope is available at that amount. The accepted checkout, order, or proposal states the actual fees, billing schedule, taxes, renewal behavior, cancellation terms, refunds if any, scope, and delivery conditions for a purchase.
4. WafflOS, Launchpad, Fractional COO, and add-ons
WafflOS is the software foundation beneath Waffl services. Launchpad is a defined setup package and does not include unlimited customization. Fractional COO is a quarter-to-quarter operating leadership engagement with the ownership level, capacity, outcomes, responsibilities, and boundaries defined in an accepted proposal. Growth Engine and other agreed workstreams are add-ons within Fractional COO, not separate top-level offers.
The free Discovery Call qualifies fit and scope. It does not include a free audit, operating plan, workflow design, implementation, or personalized strategy deliverable.
5. Acceptable use and customer responsibilities
You may not use Waffl to violate law, infringe rights, introduce malicious code, bypass access controls, interfere with the service, obtain unauthorized access, send unlawful or deceptive communications, or automate decisions that require professional or regulated judgment without appropriate controls.
You are responsible for the legality, quality, and permissions associated with the data, instructions, accounts, and systems you provide. You remain responsible for reviewing outputs and deciding whether they are suitable for live use.
6. Content, data, and intellectual property
Waffl and its licensors retain rights in the Waffl brand, platform, software, reusable methods, templates, and pre-existing materials. You retain your rights in customer data and materials you lawfully provide.
Ownership and permitted use of a custom deliverable are defined in the accepted proposal or service agreement. You grant Waffl the limited permission needed to process your materials to provide, secure, and support the agreed service.
7. Third-party services
Waffl may link to or connect with third-party tools. Those services are controlled by their providers and may change, suspend access, or apply separate fees and terms. A visible integration listing does not guarantee that every requested action is available or suitable.
You are responsible for authorizing third-party access and complying with the terms that govern your external accounts.
8. Availability, changes, and risk
Waffl may maintain, modify, or discontinue features and may pause access to protect users, systems, or legal obligations. Specific service levels apply only when stated in an accepted agreement.
To the extent permitted by applicable law, public site content and any service without a specific written warranty are provided without a promise of uninterrupted availability or a guaranteed business result. A signed agreement controls any negotiated warranty, liability allocation, indemnity, or dispute provision.
9. Suspension, termination, and disputes
Waffl may suspend or terminate access for material breach, unlawful use, security risk, or nonpayment, subject to any controlling order or agreement. Obligations that by their nature continue after termination remain in effect.
Before starting a formal dispute, contact Waffl at zjones@gowaffl.com with a concise description so the parties can try to resolve the issue. Governing law and formal dispute procedures, when applicable, are stated in the controlling accepted agreement.
10. Changes and contact
Waffl may update these terms as the services change. The effective date identifies the current public version. Material changes may require additional notice or acceptance when applicable.
